What are Whirlpool's terms of use?
Whirlpool’s terms of use (effective September 13, 2021) govern use of its websites, apps, and connected “Smart Appliances” across the U.S. and Canada, and apply to brands including Whirlpool, Maytag, KitchenAid, JennAir, Amana, Gladiator, Roper, Estate, Yummly, EveryDrop, Swash, Inglis, Affresh, and Speed Queen (Canada only). Users must be at least 18 and the age of majority where they live. The most consequential provision for consumers is a class action and jury trial waiver: anyone with a claim against Whirlpool must first notify the company’s Customer Experience Center and try to resolve it for 30 days before any court action, must bring claims individually rather than as part of a class, and waives the right to a jury trial. The waiver doesn’t apply to Quebec residents. Whirlpool’s total liability is capped at whatever the user paid for the service or $100, whichever is greater. For Smart Appliances, users consent to automatic software updates that may add, change, or remove features without notice, and acknowledge that Whirlpool can terminate Smart Features at any time. Whirlpool takes a worldwide, perpetual, royalty-free license to any user-submitted content (ratings, reviews, photos, recipes). U.S. disputes are governed by Delaware law; Canadian disputes by Ontario law. Whirlpool can change the terms without notice, and continued use means acceptance.
