If the price is broke …

So why isn’t the airline price-fixing scandal involving fuel surcharges resonating with passengers? Maybe it’s because most air travelers just care about getting the lowest price on an airline ticket, even if it means being stuck in a middle seat next to two hyperactive infants (an experience I’m all too familiar with).

But price fixing is resonating with this travel blogger.

That’s because I’m mentioned in both complaints. One of my 2002 editorials is cited as evidence that the airlines have been fixing their prices.

I don’t mind being named in a lawsuit (as long as I’m not being sued, of course). And I’m not really bothered that my name was misspelled or that they got my title wrong (I’m a travel writer, not an analyst).

What troubles me is that a commentary that I wrote four years ago — which basically said that airlines should be more forthcoming about their fuel surcharges — is being used as “proof” of a conspiracy.

So far I’ve heard from two reporters who asked if I believe the airlines are guilty. The latest, from a TV producer, wanted to know if there were any companies in the States who might be upset about the allegations (if you are, please send me a note and I’ll pass it along).

I think there’s a good chance the airlines have done what they’re being accused of.

But good luck proving it.

My op-ed essentially accused the airlines of being secretive and urged them to disclose their fees in a better way. It didn’t suggest that fuel surcharges were illegal, or were being imposed illegally.

That is something for a court to decide.
