“We’ve had a lot of cracks about the whole inspection thing”

March 14, 2008

If you really want to understand how the Southwest Airlines safety scandal is affecting passengers and employees, there’s only one thing to do. Get on a flight and strike up a conversation with a crewmember. Which is exactly what I did this morning.

The nonstop flight from Albuquerque, N.M., to Orlando took off right on time at 9:05 a.m., and it was completely full. So my first question – “Has anyone canceled their flights because of safety concerns?” – seemed moot. Clearly, no one had called off their plans to fly to Orlando today.

None of the passengers I spoke with had any misgivings about flying today, despite a firestorm of criticism over Southwest’s handling of the inspections.

I asked one of the attendants if the subject come up in interactions with passengers. I’m keeping their names out of this, for obvious reasons.

“Oh yeah,” the attendant said. “We’ve had a lot of cracks about the whole inspection thing. No serious questions. Most of them are just joking around.”

While safety isn’t a joke to Southwest’s employees, the way in which this story has been handled is something of a laughing matter within the company.

“The media has played up the negative aspect of this story,” I was told. “They’re just interested in selling more newspapers. But the fact is, we’re always two or three steps ahead of the FAA, when it comes to spotting safety problems. You don’t see that being reported anywhere, do you?”

Blaming the media for a story (or shooting the messenger, as we like to call it) is a time-honored tradition. But in this case, my Southwest friends might have a point. There are only a handful of airline reporters in the United States with the depth of knowledge and experience to put an event like this into perspective – to be able to separate the political grandstanding from the PR and get to the core issue.

I would even go as far to say that bloggers have covered the Southwest story more responsibly – more timely, with better sense of perspective and more clear-headed insights than my buddies in the mainstream media have. I should note, of course, that some of those bloggers are affiliated with mainstream news outlets, like The Dallas Morning News.

About halfway through writing this blog entry, the crew discovered me (geez, gotta get one of those privacy screens for my laptop). A flight attended slipped me an internal memo (hey Paula and Brandy, go easy on these guys … they’re just trying to help).

This is what Southwest employees are being told about inspection-gate:

We wanted to followup on this morning’s Employee Message concerning the preliminary findings of our own internal investigation and audit of our Maintenance procedures. Gary has vowed to make any changes necessary to ensure that Southwest is in full compliance with FAA Airworthiness Directives and All of our own Maintenance programs, policies, and procedures.

During last night’s review of our maintenance records, we discovered an ambiguity related to required testing. We made the decision to take a conservative approach and remove aircraft out of scheduled service. We immediately began reinspecting those aircraft. A total of 44 aircraft were affected – one was already retired, five were in maintenance for schedules checks, and the remaining 38 were removed from scheduled service.

Our decision to remove aircraft from service resulted in approximately four percent of today’s flight’s being canceled. Due to good weather conditions, the decision caused minimal schedule disruptions, and we are running more than 90 percent ontime.

A portion of the aircraft have been inspected, cleared, and returned to service. We expect to have all these aircraft inspected by early this evening. The ongoing internal review of our maintenance programs, policies, and procedures could potentially create other operational changes if we need to swap or reroute aircraft as the internal investigation and audit unfolds.

“Again, we are mindful that during Southwest’s proud 37-year history, we have safely transported the equivalent of the population of the United States – every man, woman, and child – fur and a half times over. This is a fact. We have bee a safe Company. I believe we are a safe Company. I am committed to making sure we become safer still,” said Gary.

(Gary would be Southwest chief executive, Gary Kelly.)

“If we thought the airline was unsafe,” a crewmember added, “every flight attendant would have called in sick yesterday.”

Re: Pending FBI Investigation Of Threat On Whistleblower Who Informed On FAA And Southwest

Dear Mark, Robert, Kevin, and Michael:

As you are aware, I am attorney and co-founder of a citizen group called “Quiet Rockland” which has opposed various acts of FAA malfeasance since last summer 2007, including direct FAA threat to my home community of Rockland County NY and the Hamlet of Pearl River where many law enforcement personnel themselves reside.

As of last night, Quiet Rockland and I understand from a news article posted at:

    http://cbs11tv.com/local/Southwest.Airlines.FAA.2.674307.htmlhttp://cbs11tv.com/local/Southwest.Airlines.FAA.2.674307.html

that the FBI has now commenced an investigation into threat(s) made against one or more airplane-inspector/whistleblowers, who apparently informed on FAA and Southwest Airlines regarding cracked and un-inspected airplanes thereafter flown with passengers in them. I also understand that the relevant events may have occurred in the area of Dallas or Fort Worth, Texas, and DFW Airport.

I note that on last Sunday night, Quiet Rockland itself requested a criminal investigation of FAA and Southwest, by faxing and e-mailing a press release to many media, government and other recipients, including every member of the United States Congress. The text of the press release is posted at, inter alia:
    http://media-newswire.com/release_1062069.html

While actively posting the call for the investigation and a consumer boycott of Southwest Airlines to a number of newspaper website message boards and other electronic information locations, it became apparent to me and others that Southwest Airlines and perhaps also FAA may have deputized a not-insubstantial number of persons to “blog” back, in an endeavor to effect some publicist-like “spin control” on what is obviously a very serious life-or-death matter of aviation safety. Normally, corporate (and perhaps even governmental) bloggers, a number of whom use anonymous cover and pseudonyms, might not pose a substantial problem. But in this case, it is believed by Quiet Rockland that the anonymous and other bloggers seeking to squelch lawful calls for citizen and governmental response to an aviation safety nightmare, may in fact be part of the same deceitful and criminal hydra that is the common enterprise of Southwest and FAA.

The most obvious example of these conspiratorial misuses of the electronic ether for aero-propaganda is found at Southwest’s own website at:
    http://www.blogsouthwest.com/

However, I also ask that you please consider reviewing the blogged comments located at the website of the following Dallas, TX newspaper, particularly relevant since the subject investigation events apparently took place in connection with DFW:

    http://aviationblog.dallasnews.com/archives/2008/03/southwest-airlines-carries-the.html

In the event that the newspaper takes down the blog’s text, I enclose a hard-copy of the blog-to-date to each of you, as well.

Specifically with respect to the Dallas newspaper website, it appears that at least some of the individuals calling themselves by the following screen names, may in fact be working in concert with Southwest and perhaps also FAA, on a purposeful campaign to misinform the public – and thereby making themselves a continued threat to squelch free discourse, and knowledge of, and opposition to, a callous corporate and agency disregard for citizen and air traveler safety. The screen names are:

    “__________”
    “__________”
    “__________”
    “__________”
    “__________”
    “__________”
    “__________”
    “__________”

Such endeavor on their part would be the hallmark of an oppressive totalitarian society. Thank God The United States of America is not one of them, and never will be.

It is suggested herein that the same mindset that caused threats to be made against one or more airplane inspectors or aviation whistle-blowers, may well now also be the mindset behind a very concerted pattern undertaken by multiple individuals seeking to threaten those like Quiet Rockland who would dare to challenge and question the aero-mercantile complex. This is a public safety issue, and lives hang in the balance when every single Southwest Airlines plane goes up in the air. As a citizen whose house may end up being flown-over up to 600 times a day if the FAA follows-through on its intended NY/NJ/PA Airspace Redesign, I want to know what else Southwest Airlines and the FAA are currently seeking to squelch and suppress, too.

I will very much appreciate your looking into this matter, and apprising me of the status of your inquiry into same if and as appropriate, and as you may be able. Thank you.

    Respectfully,

    John J. Tormey III, Esq.

I don’t mind the media playing up the story – even as I agree that most of the reporting shows a lack of depth. Information helps all of us, and many airlines are so quick to give an answer that technically satisfies your question without REALLY answering your question (Weather delay!). Heck, sometimes sensationalized media attention even yields a pro-consumer result. A financially stable airline like Southwest won’t get hurt by this… and every consumer benefits from knowing both that inspections are happening and Southwest is responding pro-actively.

  • Jasper

@ JARaphs: You should be very upset about the lack of depth in the reporting. This is a problem that exists in every branch of the press these days. The results is that we as the public are not informed anymore, but that we get the spin from both sides of the story and then have nothing to decide on, because nobody figured out what really is going on.

Chris, thanks for the real story that did not make it into the mainstream media. The SW crews have a much better idea about the safety of their aircraft then do those who demagogue the issue.

  • http://www.quietrockland.com John J. Tormey III, Esq.

Friday, Southwest’s CEO insisted safety was never compromised. “Airplanes were flown with the FAA’s knowledge before we completed all of the inspections eight days later,” he told CBS 11 News.
The newly released documents show in January 2006, one of the whistleblowers, Bobby Boutris, complained that Southwest was “hand-selecting the inspector…”

The report says, “When Southwest officials… learned that Mr. Boutris was to lead the inspection of the airline, they met with his FAA superior, Douglas Gawadzinski, and actively sought his removal.”

While Boutris was allowed to do the inspection, the report says Gawadzinski, “instructed him to delay the review until he gave the green light.”

The report also shows that on March 28th of last year, after Southwest disclosed it missed important safety checks, the whistleblower, Boutris, documented 21 negative findings. When the information was reported to Gawadzinski, Boutris claims he was instructed not enter them into the FAA database.

On April 9, 2007, the report says, “Boutris was informed he was being removed from his position because an anonymous complaint had been filed against him.”

CBS 11 News was unsuccessful in contacting Boutris, the other whistleblower, and Douglas Gawadzinski, who the FAA removed from overseeing Southwest Airlines last May.

On Monday, Southwest Airlines wasn’t commenting. The FAA has begun a major review of Southwest’s safety and maintenance procedures.

A ST. PATRICK’S DAY CELEBRATORY MESSAGE FROM PEARL RIVER, NY

Quiet Rockland today makes this statement in support of the pending investigation of Southwest Airlines and FAA actions, conducted by the United States Federal Bureau of Investigation (FBI):

As in the film ‘Moonstruck’, it is as if Cher just slapped FAA Acting Administrator ‘Bobby’ Sturgell in the face twice, hard, and said ‘Snap Out Of It!’. The arrogance and lawlessness of the current FAA regime is now coming to an end. The FAA house of cards is collapsing. On Sunday night March 9, Quiet Rockland called for a criminal investigation of Southwest Airlines and the FAA, as well as a nationwide boycott of Southwest. One night later (please see below), the media reported that the FBI has commenced a criminal investigation of retaliation and threats made by aeromercantile thugs against airplane safety inspector whistleblowers. Quiet Rockland thanks the FBI for commencing the investigation, and will give the FBI every bit of assistance, support, and cooperation if and as ever asked.

Quiet Rockland notes that this criminal investigation’s trail may not only lead to the senior-most levels of FAA management but perhaps also point to FAA Acting Administrator Robert A. “Bobby” Sturgell himself. Even if not, the FBI-investigated FAA and Southwest misconduct occurred under Sturgell’s watch. “Bobby” Sturgell is the DelMarVa son of the late J. Edgar Hoover’s former personal secretary Barbara Sturgell. See:
    http://www.bayweekly.com/year99/issue7_22/lead7_22.html
    http://www.TheHappyHarbor.com

If ANY American ever suggests that FBI’s or USDOJ’s actions are politically-initiated, or anything less than objective and protective of the welfare of American citizens, one need only cite the Southwest-FAA-Sturgell-Hoover pathway to prove how wrong any such skeptic would be. On this St. Patrick’s Day, every American, Irish-American or otherwise, owes a debt of gratitude to the FBI for taking a dramatic further step to keep our skies safe and protect the well-being of those of us on the ground. We look forward to the results of the FBI investigation and the related scheduled April 3, 2008 Congressional hearing at which we expect the aero-perps to be taken down.

Finally, Quiet Rockland also takes this opportunity to ask that all Americans who have ANY further information implicating FAA, Southwest, or any other aeromercantalist in any threats or retaliation against whistleblowers, or in any other unlawful activity, please come forward now to your most-proximate FBI or other law enforcement office. The text of the CBS 11 News (Dallas) March 10, 2008 article appears below.

    Let us begin.

whine and moan. Hey, Mr. Toomey – are you in it for the ‘benefit of your fellow man’s quiet sleep,’; or the money? If you were in it for your fellow man, you would be splashing your lawyer bona fides everywhere getting free advertising on a travel blog.

Exactly what is your problem? It would seem that ‘Quiet Rocklan’ is an effort to keep jets from overflying your homes, yet, you seem all worked up over Southwest aircraft that do not even overfly your homes. Whats up with that?

WN flies into ISP, PVD and MHT and ALB. It does even come close to being under 10,000 feet anywhere NEAR Rockland County NY. So, in the interest of fair disclose, how much are you being paid and why is this even remotely relevant to you? You and your group sound like a bunch of nutcases, to be honest. You can call for all the FAA investigations you want but the Dallas FBI is going to pay about as much attention to a bunch of anti-noise advocates 1400 miles aways as it would seem appropriate.

Personally, I think you picked the wrong airline to get all charged up over. WN has had one of the best reputations for maintenance in the nation. Their aircraft are consistently in better cosmetic condition than the other airlines, and tend to fix things that break. I agree with you that the FAA is the same as any other government bureaucracy but don’t you think your posts here are little off the deep end?

Boutris dislcosed 21 [TWENTY ONE?] negative findings? OHHHHH. AHHHH. Over what period of time? They operate in excess of 600 aircraft and I can PROMISE you that any ONE of them probably has 21 unresolved maintenance squawks on it right now, every day.

Give me a break. Please disclose your reasons for going after WN when the closest aircraft they operate to Rockland County is 50 miles away at Albany. Don”t give me ‘safety’ because your posts read like you are one of the tin-hat government conspiracy theorists who see the government trying to read your mind waves around every corner.

The FAA cannot be simultaneously and evil conspiratorial empire and utterly incompetent, both at the same time. Pick a theory and run with it – k?

Of course Southwest is handling it in a laughing matter. None of their employees can get through a sentence without slipping a joke in there.

I think they get their customer service training from the same place as the boat drivers at Disneyland’s Jungle Cruise. One stupid groaner after another.

It is interesting to me to think that the airline & the FAA knowingly endangered people’s lives. If they knew about this why did it take them so long to do the right thing? If they had not had the whistle blowers they would still be flying those planes.

But then again the FAA doesn’t care about anyone. They are knowingly also putting the lives and businesses in South Florida in danger but it seems they don’t care. There is a web site “www.faahope.com” It shows how the communities in South Florida don’t like the idea of being left with out any help after a major disaster.

John Tormey is the type of person who cares about other people. He is right when it comes to big airlines and the FAA. It is like letting the “Fox watch the hen house.”

  • Thomas Sullivan

    Hey Joe F,
C’mon, this nonsense that has been going on with the FAA leadership is no conspiracy theory.
    - Airlines like SWA and Northwest, going “over the heads” of FAA Inspectors to circumvent maintenance rules is a very real issue – Congressman Oberstar has launched a congressional investigation into this – the hearing is on April 4.
    - The $50mm boondoggle that is the NY/NJ/PA Airspace redesign is another scandal – currently the focus of a GAO Audit which is likely to blast the FAA.
    - Scores of near misses and Runway incursions across the country is a very real issue.
    - Airlines emergency landings because they have a minimal amount of fuel is downright scary.
    - The record shortage of Qualified Air Traffic Controllers is a Very Real problem.
    - The outsourcing of aircraft maintenance to countries where our inspectors cannot do their jobs is a very real issue.

You see Joe F, we cannot let the likes of Southwest and the FAA Administration minimize these very serious issues. The Airspace redesign has been a wake up call to many of in the Northeast. This FAA Administration has put they entire country in VERY REAL danger because of the issues outlined above, among others. Now it is time to spread the word and let the entire world know what has been going on.

Let Southwest fess up to what they did wrong here and let the President nominate a FAA head that has not already proven himself a failure.
